The eligible voters of the City Bern issue,

Based on

-       Art. 3 par. 3 lit. e of the federal law from 22. June 1979 about space planning;

-       Art. 14 par. 2 lit. b of the cantonal zoning law from 9. June 1985;

-       Art. 8 par. 1 num. 2 of the Municipal Code of the City Bern from 30. June 1963;

The following Regulation:

1. Clause: Aim and purview

Art. 1  Aim

The tree population on the territory of the City Bern shall be obtained, in the interest of the town- and landscape, the ecological balance and the cosiness of the quarters and settlements.

Art. 2  Purview

¹ The Regulation pertains for the tree population on private ground including the properties of the financial assets of population community Bern.

私人土地上的樹木也受政府規定保護及管理。

² The terms about the tree population on public ground, i.e. on public streets, squares and properties in the administrative property of the City Bern plus the municipal building inspection terms about the configuration of the private foreland and the border margin room of industrial-commercially used properties opposite of living area are reserved.

除了街道、廣場等公有地，工業用地及民生用地間的區域也列為公有地，其區域植栽列為政府保護。

³ The forest, the arboretums, the trees in nurseries and the fruit trees, except walnuts, don’t fall under this regulation, except Art. 5.

經濟林、植物園、園藝店家、果樹（核桃樹除外）不受此規定限制；條文５除外。

1. Clause: Terms of conservation保護條文

Art. 3  Tree-Protection-Areas; Concession obligatory

¹ The municipal territory of the City Bern is divided in Tree-Protection-Area A and Tree-Protection-Area B. The Tree-Protection-Area A includes the Aar river protected area and the Old Town according to the building regulations and the building plan of the City Bern. The Tree-Protection-Area B includes the rest of the municipal territory.

伯恩市的樹木保護區域共分為Ａ、Ｂ兩區，依據伯恩市建築及計劃法規，Ａ區包括Aar河及舊城區。其餘的都市區域為Ｂ區。

² In the Tree-Protection-Areas A and B, the trees of the following minimal size are protected, and the removal requires a concession.

在Ａ、Ｂ保護區內，以下樹木尺寸列為保護，砍伐需要申請通過才能執行。

a.       Tree-Protection-Area A (Aar river protected area / Old Town)

Minimal stem circumference 30 cm resp. diameter ca. 10 cm, measured 1 m above the grown ground. In the Aar river protected area Art. 79 l of the law about the implementation of the Swiss Civil Code (EGzZGB) is not applicable.

a.   保護區Ａ：最小樹圍為３０公分、直徑１０公分、樹高１公尺。Aar河保護區條文　　７９１則不在此限。

b.      Tree-Protection-Area B (all other territories)

Minimal stem circumference 80 cm resp. diameter ca. 25 cm, measured 1 m above the grown ground.

b.   保護區Ｂ：最小樹圍為８０公分、直徑２５公分、樹高１公尺。

³ In case of multi-stemmed trees the circumference of the stems is totalled up.

多幹樹種的樹圍以全部總合為計算方式。

⁴ Equal to removal is the take off of essential parts of the tree.

修剪樹木的重要局部也等於砍伐。

Art. 4  Reasons for Concessions砍伐許可

¹ The Concession for the removal of a tree or the take off of essential parts is granted, if

砍伐樹木或修剪重要局部能獲得許可，如果：

a.       the removal is necessary because of a tree’s state of health;

b.      the preservation of a tree is connected to a significant danger for people or things;

c.       the removal is a tending strategy for the surrounding tree population;

d.      living areas are significantly affected by the shadow, humidity or other impacts;

e.       other clearly outweighing public or private interests require the removal or trimming of the tree.

a.   樹木的健康狀況不佳

b.   如果市民及其他事物的安全受到危及

c.   以保護週圍其他樹種

d.   市民的居住區域嚴重受到該樹木遮蔽、溼度或其他影響

e.   其他相關公眾需求

² Within the scope of a weighing of interests it is namely the value of the tree (which is requested to be removed) for the town- and landscape, his ecological importance and the possibility of a full-value replacement threw a new planting which has to be considered.

如果決議砍伐樹木，需考慮該樹的生態重要性與重新種植與被砍伐樹種價值相當的樹木。

³ The removal of trees or groves particularly worthy of protection within the meaning of the zoning law (BauG) is only granted exceptionally and on condition that a full-value replacement in location and tree species is made.

區域劃分法規(BauG)內的保育樹種或林地，樹木砍伐需要在該區種下有同等生態價值的樹木。

Art. 5  Replacement planting樹木砍伐後，新植的樹木

¹ In the Removal-Concession, the authorities normally dispose for every removed tree, a appropriate replacement planting on the same or exceptionally, with the agreement of the affected landlord, on a neighbouring piece of land. A replacement planting can also be a fruit tree. The cost of the replacement planting are paid by the applicant.

新植下的樹木需有地主的同意，此新植的樹木也可為果樹；植樹的成本需由申請砍樹者負擔。

² The replacing trees planted on the authorities order are protected according to this regulation, no matter what size.

新植的樹木（用以替代被砍伐的樹木），不分樹木大小皆受保護。
